AGREEMENT BETWEEN CUSTOMER AND CABO SAILS
Welcome to the Cabosails.com website. This Site is provided solely to assist customers in gathering product and service information, determining the availability of product and service-related goods and services, making legitimate bookings, and for no other purposes. The terms, “we”, “us”, “our” refer to Cabo Sails, a Cabo San Lucas, Mexico based company. Cabo Sails arranges sailing, cruising, snorkeling, sunset cruises and whale watching tours advertised on this website. All references to “you” or “your”, as applicable, means the person that accesses, uses, and/or participates on the website in any manner.
RESERVATIONS AND DEPOSITS
Reservation deposits are accepted with a valid credit, debit card or PayPal payment. After the deposit is received, you pay the remaining balance the day of your tour when you check-in prior to your tour.
PRICES
Prices are in U.S. Dollars. Prices are based on the boat you choose and the number of guests on board. Prices include tax. Each reservation is for a specified number of guests. Additional fees apply when the specified number of guests exceeds the number of guests on the original booking. There is an additional 5% bank service fee with credit card payments.
CONFIRMATION DOCUMENTS
Confirmations are provided immediately when you book your reservation online. If you book your reservation through a hotel concierge, the concierge provides your confirmation details. If Cabo Sails cannot accommodate your Booking, you will be contacted within 24 hours.
CANCELLATIONS & REFUNDS
72-hour cancellation notice or medical form with proof of illness or injury is required to refund your deposit. No-shows are charged in full. If the weather is bad, Cabo Sails will do their best to reschedule your tour based on space availability, otherwise, your deposit will be refunded in full. If your tour is rescheduled due to weather or any other reason, a 72-hour cancellation notice is still required to refund your deposit.
RESPONSIBILITY AND ASSUMPTION OF RISK
Upon checking in for your tour, you are required to sign a release of risk form that you are voluntarily participating in activities that can be dangerous including boating, sailing, cruising, snorkeling, swimming and whale watching and hereby assumes all risks of injury. The release of risk form also outlines the costs for you to pay to replace items that you damage or lose during your tour. You will be notified on the release of risk form of the current replacement cost for items lost including the following:
a. Stainless steel cups
b. Snorkeling gear including masks and fins
c. Paddle boards
d. Paddle board oars
e. Water mat
NOT INCLUDED IN PRICES
Tour prices do not include gratuities for the crew. Most guests tip 15-20%. Transportation to and from our location is not included. It is your responsibility to take a taxi to and from our location and to arrive 30 minutes prior to your tour departure time.
MARKETPLACE AGREEMENT
Cabo Sails uses PayPal as a third-party service provider for payment services. By buying on Cabo Sails you agree to be bound by PayPal´s Privacy Policy and hereby consent and authorize Cabo Sails and PayPal to share any information and payments instructions you provide with Third Party Service Providers to the minimum extent required to complete your transaction.
VENUE IN CASE OF DISPUTE
When booking a tour to Mexico and using the services of Cabo Sails, you acknowledge and agree that the proper legal venue for any dispute or claim regarding tour arrangements made by Cabo Sails shall be made in Mexico.
PROHIBITED ACTIVITIES
You agree not to:
1. Use this site or its contents for any commercial purpose.
2. Make any false or fraudulent bookings.
3. Access, monitor or copy any content or information of this Site using any robot, spider, scraper or other automated means or any manuel process for any purpose without our express written permission.
4. Copy or reproduce any portion of this Site without the express written consent of Cabo Sails.
